Terms of Use

  1. General Provisions

KPMG IT Service OOD (“KPMG ITS”) is a limited liability company, incorporated and existing under the laws of Bulgaria, UIC 203572873, VAT BG203572873, having its seat and registered address at 45/A Bulgaria Blvd., Sofia 1404, Bulgaria, affiliated with KPMG International Limited, a private English company limited by guarantee.

KPMG ITS uses an external recruitment platform called TalentLyft (the “Platform”) operated by AdoptoTech d.o.o., a Croatian company, having its seat and registered address at Ulica Ljudevita Posavskog 34A, 10000 Zagreb, VAT: HR57168930727.

These Terms of Use (the “Terms”) govern your access and use of the Platform available at the following link: https://careers.kpmg-its.bg/

Please read these Terms carefully as they contain important information regarding your rights and obligations with respect to your access and use of the Platform, including but not limited to various limitations, exemptions, and exclusions.

By accessing or using the Platform, you enter into a legal agreement with KPMG ITS and state that you have read, understand, and agree to be bound by the following Terms in their entirety, when you access or use the Platform and apply for employment with us.

  1. The Platform

2.1. Accessing and/or using the Platform, you are able to:

  • Participate in the current and, based on your additional consent, future recruitment campaigns conducted by KPMG ITS.
  • Upload CV, cover letter, certificates, and other relevant documents.
  • Search for new job offers.
  • Manage your Candidate Portal as described below

2.2. Technical requirements to use the Platform:

You can use the Platform via Internet-enabled computer/mobile device with one of following browsers:

  • Google Chrome
  • Mozilla Firefox
  • Microsoft’s Edge
  • Internet Explorer.

Technical factors such as bandwidth, network configurations and computer browser settings can affect the speed and accessibility of the Platform. KPMG ITS does not guarantee the continuous, uninterrupted or error-free operability and availability of the Platform, or compatibility with your computer browser or any other part of your computing systems.

KPMG ITS cannot guarantee that the Platform is invulnerable to hacking or other unauthorized access by third parties or any other form of malicious attacks. You acknowledge that transmission of information and/or documents over the Internet is not entirely secure and there is always the possibility of unauthorized interception by third parties. In any case, KPMG ITS undertakes the necessary measures to ensure the security of your data as is and as far as required by applicable laws.

  1. Candidate Portal

When using our Platform, you represent and warrant that you have reached the age of majority in the jurisdiction in which you reside, and that you are in any event at least 18 years old. In any case, please consider that should you become a selected candidate you may only be hired and commence work upon fulfilment of any and all requirements of applicable legislation, incl. on minimum age for employment, issuance of relevant permits from authorities, etc.

To apply for employment with us you will need to provide certain information about yourself. To learn more, please refer to our Privacy Notice Job Applicants. If you apply under a particular job advertisement, we create a Candidate portal for you. The purpose of this portal is to enable you to manage your job applications and personal information. On Candidate Portal, you can:

  • See your job applications.
  • See all your personal information.
  • Export your personal information.
  • Update your personal information.
  • Request deletion of your personal information.

When you apply for an employment, you will receive an email with link to your Candidate Portal. By clicking on the respective link, you can access the part of your Candidate Portal where you can see all your applications and submitted data. In order to see and manage your personal information, you need to request a token by clicking on Send token button. An email containing unique token for accessing your personal data will be sent to your email address. This token is valid only for one hour upon issuing. Upon token expiration, you need to request a new one. After you receive a token and click on View button, your Candidate Portal will open again. Export, Update and Delete action buttons are visible on the right side of the page. Above these action buttons, a contact email for matters concerning personal data is displayed.  

  1. Your obligations

You agree that you will not:

  • Use the Platform and your Candidate Portal for any purpose which is in breach of any applicable law or regulation.
  • Link or otherwise make available any illegal content.
  • Use the Platform to upload, store, post, email, transmit or otherwise make available any content that infringes any intellectual property rights or data protection, privacy or other rights of any other person, is defamatory or in breach of any contractual duty or any obligation of confidence, content that is obscene, sexually explicit, threatening, inciteful of violence or hatred, discriminatory (on any ground), or content that does not comply with all applicable laws and regulations (“Prohibited Content”).
  • Access or use your Candidate Portal in any manner that could cause loss of, or corruption or damage to any software or computer systems.
  • Interfere with or disrupt the operation of the Platform or the servers or networks used to make the Platform available, including by hacking or defacing any portion of the Platform, or violate any requirement, procedure or policy of such servers or networks.
  • Reproduce, copy, modify, adapt, translate, create derivative works of, sell, rent, lease, loan, timeshare, distribute or otherwise exploit any portion of (or any use of) the Platform except as expressly authorized herein.

You shall not commit any other act or omission that may be considered an infringement of the present Terms and rules of good faith and/or duty of care and/or that may cause any damage to KPMG ITS, including damage to its name and good reputation.

You also agree to:

  • Keep the information that you provide through the Platform (e.g., your name, email address, telephone number, etc.) accurate, complete, and up to date at all times.
  • Keep your Candidate Portal secure and not allow anyone else to access or use your Candidate Portal.
  • Notify KPMG ITS promptly if you suspect any security breach or other suspicious activity.

You acknowledge that access to and use of the Platform may be suspended or limited at any time and that the content posted on the Platform may not be recoverable. You are fully responsible for retaining copies of all content and documents uploaded on the Platform. KPMG ITS has and undertakes no responsibility for recovering or providing to you any content or documents uploaded on Platform, nor shall it assume any liability for that matter.

If you do not comply with these Terms (or if KPMG ITS has reasonable grounds to suspect or investigates suspected non-compliance), KPMG ITS may suspend or terminate your access to the Platform or take any other steps KPMG ITS considers appropriate.

  1. Limitation of liability

Using or accessing the Platform you declare that KPMG ITS is not liable for:

  • Any damage resulting from ceasing the provision of the Platform.
  • Any damage resulting from the provisioning of untrue, inaccurate, or incomplete data or information by you.
  • Any damage resulting from not observing the provisions of these Terms of use by you.

To the extent permitted by applicable law, KPMG ITS disclaims for itself and its suppliers, all warranties and liability for any damage and remedies whether direct, indirect, or consequential, or for any loss of profit, contracts, data, goodwill, or other similar losses arising from the use of the Platform. You are solely responsible for all use you make of the Platform and of the content posted on the Platform.

  1. Changes to these Terms of Use

We reserve the right to update these Terms of Use at any time in our sole discretion. To the extent permitted by applicable law, such updates will be effective immediately. You agree to the updated Terms by continuing to use or access the Platform.

  1. Dispute resolution and governing law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Bulgaria, and you agree to the exclusive jurisdiction of the courts of the Republic of Bulgaria to settle any disputes which may arise out of your use of the Platform.
